Terms and Conditions for the Service JupyterHub.nrw

1. Formation of Contract and User Group

(1) The usage contract between the University of Münster and the user comes into effect when the user accepts the terms and conditions as well as the data protection statement during the registration process.

(2) The service is open to: - Students, employees, and researchers with a user account at participating universities of the JupyterHub.nrw project - Members of PUNCH4NFDI - Members of NFDI4BIOIMAGE

(3) The login to the system takes place via the DFN authentication and authorization infrastructure (AAI) and, if applicable, the AAI systems of the relevant NFDI consortia.

2. Permitted Use

(1) The service may only be used for purposes directly related to work, study, teaching, or research at participating universities of the JupyterHub.nrw project or within the framework of PUNCH4NFDI or NFDI4BIOIMAGE.

(2) The provisions of the current IT usage regulations of the University of Münster apply.

(3) The service is primarily intended for interactive sessions of short duration (usually up to 8 hours). Sessions that exceed this duration or are inactive can be terminated without prior notice to the user. Any unsaved data may be lost in this case.

(4) Each JupyterHub user is responsible for their own JupyterHub account, including any data stored there, as well as for complying with these terms and conditions. In cases of misuse, the account can be blocked or deactivated administratively. If necessary to end the misuse, user data can be deleted, if appropriate given the severity of the offense and the weight of the affected legal interests. The provisions of section 6 apply accordingly.

3. Allocation of Resources

(1) By default, all users receive access to a basic offer of computing power and RAM.

(2) Additional resources are allocated to specific user groups (e.g., employees) based on group membership, either permanently or temporarily, and can be requested at jupyterhub@uni-muenster.de. There is no entitlement to these resources.

4. Data Storage

(1) The service operates in the Uni Cloud Münster, and data stored by the user (home directory) is saved there for the duration of use of the service. After six months without login, the stored data will be deleted.

(2) When using connected external services (Sciebo, PUNCH4NFDI, NFDI4BIOIMAGE), data retrieved from these services may be temporarily cached in the Uni Cloud Münster for technical reasons (usually until logout). In cases of technical disruptions, data can be retained for up to 30 days to prevent data loss.

5. Limitations of Availability

There is no claim to availability and correctness of the system. The operation of the service takes place on a best-effort basis, i.e., according to customary diligence. Adjustments, changes, and additions to the service, as well as measures to detect and rectify functional disturbances, can lead to temporary interruptions or impairments of availability.

6. Liability Disclaimer

(1) Users are liable for all disadvantages incurred by the University of Münster due to the misuse or unlawful use of the service or resulting from the fact that they culpably fail to fulfill their obligations under these terms and conditions.

(2) Users release the University of Münster from all claims if third parties assert claims for damages, cessation, or other claims against the University of Münster due to unlawful or abusive behavior that is based on the culpable conduct of the users.

(3) Claims for damages by users are excluded unless the damage is due to gross negligence or intentional misconduct by the University of Münster or its employees, statutory representatives, or assistants. For slight negligence, the University of Münster is only liable if an essential contractual obligation (an obligation whose fulfillment makes the proper execution of the contract possible and on which users regularly rely) has been breached by the University of Münster, its statutory representatives, senior employees, or assistants. The University of Münster is only liable for foreseeable damages that typically must be expected. The University of Münster is not liable for data loss to the extent that the damage is based on the fact that users have failed to perform data backups and thus ensure that lost data can be restored with reasonable effort.

(4) Liability for personal injury is governed by statutory provisions.

7. Final Provisions

(1) The University of Münster reserves the right to change or supplement these terms and conditions at any time and will inform users about this during the login process. Users then have the option to terminate the usage relationship and delete their account. To continue using the service, users must agree to the changes.

(2) The relationships between users and the University of Münster regarding the use of the "JupyterHub.nrw" service are subject to German law, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory international private law provisions apply.

(3) Should individual provisions of these general terms and conditions be or become invalid, this does not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that corresponds to the purpose of the agreement as closely as possible. The same applies if these general terms and conditions prove to be incomplete or unenforceable.

(4) In cases of contradictions between the German and English versions of these terms and conditions, the German version takes precedence.
